Forbidden Tickets is referred to by name or “We”. When this Privacy Policy uses the term “Producer”, we mean event producers using Forbidden Tickets to create events for ticket buyers or ticket registrants. Ticket Buyers and third parties using Forbidden Tickets to either purchase a ticket for an event or to register for an event are all referred to in these Terms collectively as “Buyers”, “Buyer”, “You”, or “Your”. Producers and Buyers are collectively referred to as “User” and “Users”.
We collect Personal Data that Users voluntarily provide when they inquire about, list, produce, register for, transfer, or purchase tickets for events listed on Forbidden Tickets. We may also receive Personal Data from third party sources, such as other Users, social media, payment processing partners, or other third parties. When You provide Personal Data to Forbidden Tickets for an event, whether that information is Yours or a third party’s, both Forbidden Tickets and the Producer of that event may receive and use the information provided. The Personal Data collected can include names, email addresses, phone numbers, and any other information provided by Users or third parties that might personally identify the User. Additionally, Producers can establish event registration pages where Buyers may voluntarily submit a variety of information. Forbidden Tickets does not dictate or oversee the specific Personal Data that Producers collect from these voluntary submissions. Forbidden Tickets may collect and share data provided by Buyers, on behalf of a Producer, for the purpose of facilitating the specific event for which the ticket was intended.
Forbidden Tickets does not see or store identifying credit card numbers. Identifying credit card information is only stored with the payment processor. In order to buy a ticket on Forbidden Tickets, Buyers will need to provide financial information (e.g. credit card numbers, expiration dates, pin number) some of which may constitute Personal Data.
We collect and use Personal Data in a manner that is consistent with this Privacy Policy and applicable privacy laws. We may use the Personal Data as follows: If You provide Personal Data for a certain purpose, we may use the Personal Data in connection with the purpose for which it was provided. For instance, if You contact us by email, We will use the Personal Data You provide to answer Your question or resolve Your problem and will respond to the email address from which the contact came. Additionally, if You registered, signed up for, added Yourself to a list, or made a purchase for an event on Forbidden Tickets, Your name and email address is available to the Producer and Forbidden Tickets.
Forbidden Tickets will never sell Your Personal Data. We consider this information to be a vital part of our relationship with all Users. Therefore, we will not sell Personal Data to third parties, including third party advertisers. There are certain circumstances in which We may disclose, transfer, or share Personal Data between Buyers and Producers without further notice, as set forth in this Privacy Policy.
When a Buyer registers for an event, signs up for communications, adds themselves to a list, or otherwise inputs Personal Data (such as through a web form) to communicate with a Producer in order to participate in an event, the Producer will receive and may use that information. For instance, the Producer may send marketing or other communications, using contact information that a Buyer has provided. Forbidden Tickets does not control or oversee external communications between Buyers and Producers.
Forbidden Tickets may store Personal Data, and such information may be stored by third parties to whom we have transferred it in accordance with this Privacy Policy. Forbidden Tickets stores Personal Data on a secure server provided by Digital Ocean (https://www.digitalocean.com/security), a reputable cloud service provider. We take what we believe to be reasonable and secure steps to protect the Personal Data collected by Forbidden Tickets from loss, misuse, unauthorized use, access, inadvertent disclosure, alteration, and destruction. However, no network, server, database, or Internet or email transmission is ever fully secure or error free. Therefore, Users should take special care in deciding what information is sent electronically. Please keep this in mind when disclosing any Personal Data. We retain Your Personal Data for as long as We deem necessary, and may retain Your Personal Data indefinitely, to provide You with our services, to provide Event Producers with past order information as needed, or for other important purposes such as complying with legal obligations, resolving disputes, and enforcing Our agreements.
You confirm that You have read and understand the cancellation policy for an event prior to purchasing a ticket. The cancellation policy is clearly stated on the checkout page for Your consideration.
The Buyer will receive a refund for a ticket cancellation based on the cancellation policy that was set at the time of ticket purchase. Forbidden Tickets service fees will be retained when an order is refunded, unless the event is cancelled or if the Buyer was charged multiple times in error. For nonrefundable events, the cancellation policy explicitly states that cancellations are not possible. Consequently, while Buyers may request a refund, they are not entitled to receive one, even if the event is later cancelled. For events with a cancellation policy that specifies a partial refund calculated as a percentage of the ticket price, Buyers are entitled to receive only that allocated percentage as their refund, even if the event is later cancelled.
In the case of a cancelled event, Producers may work with Buyers to either credit the ticket purchase toward a future event or refund the ticket purchase including fees back to the Buyer. Forbidden Tickets may work with both Producers and Buyers to facilitate refunds or credits for cancelled events. For nonrefundable events, the cancellation policy explicitly states that cancellations are not possible. Consequently, while Buyers may request a refund, they are not entitled to receive one, even if the event is later cancelled. For events with a cancellation policy that specifies a partial refund calculated as a percentage of the ticket price, Buyers are entitled to receive only that allocated percentage as their refund, even if the event is later cancelled.
By choosing to participate in certain events, you acknowledge and accept that they may come with inherent risks, such as potential illness, physical injury, or even death. You consciously and voluntarily assume these risks, understanding the possible consequences of your participation.
You agree that to the extent permitted by applicable laws, the services offered by Forbidden Tickets are provided on an “as is” and “as available” basis. Forbidden Tickets expressly disclaims all warranties of any kind, expressed or implied, including, but not limited to, implied warranties of merchantability, title, non-infringement, and fitness for a particular purpose.
You acknowledge that Forbidden Tickets cannot oversee and has no control over the quality, safety, or legitimacy of content tied to any event and does not guarantee the accuracy of information provided by Producers. Forbidden Tickets is not responsible for, and hereby disclaims all liability stemming from, the actions or neglect of any Producer, their associates, or any person or entity You choose to engage with in relation to an event on Forbidden Tickets.
You hereby agree to release Forbidden Tickets from all damages (whether direct, indirect, incidental, consequential, or otherwise), losses, liabilities, costs, and expenses of every kind and nature, known and unknown, arising out of a dispute between You and an Event Producer, or You and Forbidden Tickets, or You and a third party in connection with Forbidden Tickets. In addition, You waive any applicable law or statute, which says, in substance: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM MUST HAVE MATERIALLY AFFECTED HIS SETTLEMENT WITH THE RELEASED PARTY.”
You agree to defend, indemnify, and hold Forbidden Tickets, and its affiliates, and, as applicable, each of its respective agents, licensors, payment processing partners, and other partners, harmless from any and all damage (whether direct, indirect, incidental, consequential, or otherwise), injury, loss, liability, cost, and expense (including, without limitation, reasonable attorneys’ and accounting fees) resulting from any claim, demand, suit, proceeding (whether before an arbitrator, court, mediator, or otherwise), or investigation made by any third party due to or arising out of (a) Your improper use of Forbidden Tickets services, (b) Your breach of any applicable local, state, provincial, national, or other law, rule or regulation, or the rights of any third party, (c) any incidents occurring at an event listed on Forbidden Tickets, or that Forbidden Tickets was providing services to with respect to that event. This indemnification shall not apply to the extent that a claim arises out of Forbidden Tickets’ gross negligence or willful misconduct.
You agree that to the extent permitted by applicable laws, or as otherwise set forth herein, Forbidden Tickets, and any person or entity associated with Forbidden Tickets, will not be liable to You or any third party, for any indirect, incidental, special, consequential, punitive, or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data, opportunity costs, intangible losses, or the cost of substitute services (even if Forbidden Tickets has been advised of the possibility of such damages), or Your content. Nothing in these Terms is intended to exclude or limit any condition, warranty, right, or liability which may not be lawfully excluded or limited.
